SUBSCRIPTION & PURCHASE TERMS

1. Scope
These Terms apply to purchases made through www.foolsforfacades.com from The Facade Collective OÜ, trading as Fools for Façades® (“FFF”). They cover single digital issues, digital subscriptions, single printed issues, print subscriptions and any other publication or membership expressly offered at checkout.

3. Product information
The product page and checkout state the content, format, access period, publication frequency, billing frequency, price, taxes, shipping charges, supported territories and any material technical requirements.

Digital products may be accessed through a browser, account, secure viewer, download link or another method described at purchase. Printed products are delivered to the address entered at checkout.

4. Orders and contract formation
You must provide accurate order, billing and delivery information. By selecting the final payment button, you make an offer to purchase the product shown in the order summary.

A contract is formed when we send an order confirmation or provide digital access, whichever occurs first. If we cannot accept the order, we will notify you and refund amounts collected.

We may reject an order for reasonable reasons, including product unavailability, payment failure, suspected fraud, an obvious pricing error, legal restrictions or an unsupported delivery destination.

5. Prices, VAT and shipping
Prices are displayed in euros (EUR). Any VAT or other tax that we are legally required to collect, together with any shipping charge, is shown before payment. Import duties, customs charges or local taxes outside the seller’s collection obligations may be payable by the recipient and are not included unless expressly stated.

If a displayed price contains an obvious error, we may cancel the order and refund the payment or invite you to confirm the correct price.

6. Payment
Payment is processed by Stripe using the methods shown at checkout. You authorise the payment provider and FFF to charge the stated amount and, where automatic renewal is selected, future renewal payments in accordance with these Terms.

We do not normally store complete payment-card details. Payment providers may apply their own terms, authentication, fraud-prevention and privacy procedures.

7. Digital delivery and access
Digital access is provided using the method and for the period described at checkout. You are responsible for a compatible device, browser, internet connection and accurate email address.

Access is personal to the purchaser or licensed organisation. You must not share credentials, distribute files, circumvent access controls or make paid content available to unauthorised users.

We may make reasonable updates to the viewer, account system or delivery method, provided that the purchased content remains accessible in a materially equivalent manner during the promised access period.

8. Printed delivery
Printed orders are shipped to the destinations available at checkout through printers, fulfilment partners, postal operators or carriers selected for the destination. Indicative delivery times are displayed at checkout and repeated in the order confirmation. Delivery dates are estimates unless expressly guaranteed.

Risk of loss transfers as provided by mandatory consumer law. Please inspect the parcel promptly and notify s.mighali@foolsforfacades.com of damage, non-delivery or an incorrect item, including photographs where reasonably requested.

You are responsible for providing a complete and accurate address. Additional costs caused by an incorrect address, refused delivery or uncollected parcel may be charged where permitted by law.

9. Subscription term and renewal
The product page and checkout state whether a subscription renews automatically or ends at the conclusion of the purchased term.

Where automatic renewal is offered, the billing frequency, renewal price or method for determining it, renewal date and cancellation method are displayed before payment. The stored payment method may be charged on or shortly before the renewal date. Renewal reminders are provided where required by law or promised at checkout.

Where automatic renewal is not stated at checkout, the subscription ends at the conclusion of the purchased term and no further payment is taken without a new order.

You may cancel a future automatic renewal through the account area, where available, or by emailing s.mighali@foolsforfacades.com. Cancellation stops the next renewal and does not normally generate a refund for the current paid period, except where required by law or stated in the Refund Policy.

10. Price changes
For one-off purchases, the price is fixed when the order is accepted. For renewing subscriptions, we may change the price for a future renewal by giving reasonable advance notice. You may cancel before the new price takes effect. A price change does not alter the current paid term.

11. Publication schedule and editorial changes
The FFF Journal is intended to be published quarterly, with four issues planned per year. Publication dates, page counts, contributors and editorial themes may change. A reasonable change to the schedule or contents is not a breach where the subscription continues to provide substantially the number and type of issues promised.

If an issue or subscription is permanently discontinued, we will provide an appropriate remedy, such as a pro-rata refund, replacement product or account credit, subject to applicable law.

12. EU/EEA consumer withdrawal rights
If you are an EU/EEA consumer, you generally have a 14-day withdrawal period for distance contracts, subject to legal exceptions and the rules below.

Digital content supplied immediately
Where you request immediate access to digital content before the 14-day period expires, checkout must obtain your prior express consent to begin supply and your acknowledgement that you lose the withdrawal right once performance begins. If those requirements are validly satisfied and access begins, you may no longer have a change-of-mind withdrawal right for that digital content.

If immediate supply has not begun or the required consent/acknowledgement was not validly obtained, statutory withdrawal rights remain available.

Digital services or continuing access
Where a digital service begins during the withdrawal period at your express request, you may withdraw within 14 days but may be required to pay a proportionate amount for the service supplied before withdrawal, where allowed by law.

Single printed magazines
The statutory withdrawal exception for the supply of newspapers, periodicals or magazines may apply to single printed issues. This does not affect rights relating to defective, damaged or incorrect products.

Print subscription contracts
The exception for individual newspapers, periodicals or magazines does not automatically exclude subscription contracts. The applicable 14-day period and return arrangements will be applied in accordance with mandatory law.

To withdraw, send a clear statement to s.mighali@foolsforfacades.com or use the model form in the Refund, Cancellation & Returns Policy. You may use the form but are not required to do so.

13. Conformity and defects
Digital content and services must conform to the contract and applicable consumer law. If digital access is not supplied, is inaccessible or materially differs from the description, contact us so that we can restore access, provide the correct content or offer another remedy required by law.

Printed products that are damaged, defective or incorrect will be replaced, repaired where appropriate, or refunded in accordance with mandatory law and the Refund Policy.

14. Promotions
Promotional codes are subject to any specific conditions stated with the offer. Unless stated otherwise, codes cannot be exchanged for cash, combined, applied retrospectively or used after expiry. We may refuse a promotion used fraudulently or contrary to its conditions.

15. Business purchases
If you purchase on behalf of a company, you confirm that you have authority to bind it. Consumer-only withdrawal and jurisdiction rights do not apply to a purchase made wholly for business purposes, except where local law provides otherwise.

16. Suspension and termination
We may suspend digital access for payment failure, fraud, unauthorised sharing, infringement or serious breach. We will restore access after the issue is resolved where appropriate. Termination does not affect rights or obligations accrued before termination.

17. Force majeure
We are not responsible for delay caused by events beyond our reasonable control, such as postal disruption, supplier failure, natural disaster, war, civil unrest, governmental action, widespread network outage or cyber incident, provided that we take reasonable steps to minimise the effect. Mandatory consumer remedies remain unaffected.

18. Governing law and disputes
These Terms are governed by the laws of Estonia. Consumers retain mandatory protections of their habitual residence and may have the right to use their local courts. For business customers, the competent courts of Estonia have exclusive jurisdiction, unless mandatory law requires otherwise.
