1. Who we are
The website www.foolsforfacades.com is operated by The Facade Collective OÜ, trading as Fools for Façades® (“FFF”, “we”, “us” or “our”). Our legal and contact details are set out in the Legal Notice.

2. Acceptance of these Terms
By accessing or using the website, you agree to these Terms of Use. If you purchase a publication or subscription, the Subscription & Purchase Terms and Refund, Cancellation & Returns Policy also apply. Our Privacy Policy and Cookie Policy explain how we process personal data and use technologies.

If you do not agree, do not use the website.

3. Editorial and informational nature
FFF publishes editorial, educational and commercial content about façades, building envelopes, architecture, engineering, materials, products, projects and related industries.

Content is provided for general information and professional discussion. It is not project-specific architectural, engineering, legal, fire-safety, structural, product-certification or other professional advice. You must obtain advice from appropriately qualified professionals and verify applicable standards, codes, calculations, certifications, product data and site conditions before relying on content for a project, specification, purchase or safety decision.

The views expressed by contributors are their own unless stated otherwise. References to a company, system or product do not constitute a guarantee, certification or endorsement.

4. Availability and changes
We may update, suspend, withdraw or restrict any part of the website for operational, editorial, security or commercial reasons. We do not guarantee that the website or any content will always be available, uninterrupted, complete or error-free.

5. Accounts and security
Where an account is offered, you must provide accurate information and keep your login details confidential. You are responsible for activity carried out through your account, except where caused by our breach of duty.

You must notify s.mighali@foolsforfacades.com promptly if you suspect unauthorised access. We may require a password reset, suspend an account or request identity verification where reasonably necessary to protect users or the service.

6. Permitted use
You may access the public website and purchased content for your own personal or internal professional use, subject to these Terms and the Copyright & Intellectual Property Policy.

You must not:

• copy, republish, sell, license, distribute or commercially exploit substantial parts of the website or publications without written permission;
• share paid account credentials or provide unauthorised access to digital publications;
• scrape, crawl, harvest, index or extract content through automated means except where expressly permitted in writing or required by law;
• use content to train, develop, benchmark or improve an artificial-intelligence or machine-learning system without written permission, except to the extent a restriction is not legally enforceable;
• remove credits, rights notices, trademarks or technical protection measures;
• introduce malware, attempt unauthorised access, overload the service or interfere with security;
• use the website unlawfully, fraudulently, abusively or in a way that infringes another person’s rights;
• misrepresent affiliation with FFF or imply endorsement without authorisation.

7. Intellectual property
Unless otherwise stated, the website, journal design, articles, branding, databases, graphics, videos and other materials are owned by or licensed to FFF and are protected by intellectual-property laws. “Fools for Façades” and associated logos are trademarks or protected brand assets of FFF.

Limited quotation and sharing may be allowed as described in the Copyright & Intellectual Property Policy. No ownership rights are transferred to you.

8. Submissions and communications
If you submit an article, image, comment, pitch, project, press material or other content, you confirm that you are entitled to provide it and that it does not unlawfully infringe third-party rights.

Unless a separate contributor or licence agreement applies, you grant FFF a non-exclusive, worldwide, royalty-free licence to review, edit, format, reproduce and communicate the submitted material solely for evaluating the submission, publishing the agreed contribution, promoting it and maintaining the publication archive. You retain ownership of your original material.

You must clearly disclose credits, usage restrictions, embargoes, conflicts of interest, sponsorship and any material created or materially altered using generative AI.

9. Third-party links and services
The website may contain links to or embedded content from third parties. We do not control and are not responsible for their availability, accuracy, security, products, terms or privacy practices. A link does not imply endorsement.

10. Paid products and subscriptions
Purchases are governed by the Subscription & Purchase Terms and the Refund, Cancellation & Returns Policy displayed at checkout. Product descriptions, price, taxes, billing frequency, delivery and access details shown at the time of purchase form part of the contract.

11. Disclaimer of warranties
To the fullest extent permitted by law, the website and free content are provided on an “as available” basis. We do not promise that content is suitable for a particular purpose, technically complete or current in every jurisdiction.

Nothing in these Terms excludes statutory rights or warranties that cannot lawfully be excluded.

12. Liability
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, fraudulent misrepresentation, wilful misconduct, or death or personal injury caused by negligence where applicable.

Subject to that, FFF is not liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill, data or anticipated savings arising from use of free editorial content or inability to access the website, except where applicable consumer law provides otherwise.

For business users, our total aggregate liability arising from the website or a paid product will not exceed the total amount paid by that business user for the affected product during the twelve months preceding the event giving rise to the claim. This business limitation does not apply where prohibited by law.

Consumer liability is subject to the mandatory law of the consumer’s country of residence.

13. Suspension and termination
We may suspend or terminate access where reasonably necessary because of non-payment, account sharing, infringement, security risks, unlawful conduct or serious breach of these Terms. Where appropriate, we will provide notice and an opportunity to remedy the issue.

14. Governing law and disputes
These Terms are governed by the laws of Estonia. If you are a consumer, this choice does not deprive you of mandatory protections available under the law of your habitual residence, and you may have the right to bring proceedings in your local courts.

For business users, the competent courts of Estonia have exclusive jurisdiction, unless mandatory law requires otherwise or we agree otherwise in writing.

15. Changes to these Terms
We may update these Terms for legal, security, technical or service reasons. The version in force when you place an order governs that order, unless a change is required by law. For ongoing services, material changes will be notified in advance where required.
